Jurisdiction and enforcement of UPC decisions

The landscape of jurisdiction in European patent litigation has evolved dramatically over the past two decades, shaped by the interplay of the Brussels I bis Regulation and the steady march toward unified patent enforcement. The recent Electrolux (C339/22) decision by the ECJ marks another milestone. From the early days of fragmented national litigation to the UPC, practitioners have witnessed a profound transformation in how crossborder patent disputes can be coordinated. In the first session of the seminar, we look at this evolution and the possibilities the new UPC system offers for crossborder patent litigation.

When it comes to enforcement, the synergy between the UPC framework and the Brussels Regulation is creating unprecedented opportunities and challenges for rights holders. The mechanisms for recognizing and enforcing UPC judgments across contracting Member States promise faster and more efficient remedies, while still accommodating the complexities of parallel national proceedings and thirdcountry considerations. The second session of the seminar will delve into best practices for leveraging these tools, ensuring that enforcement strategies are both robust and adaptable in the face of the rapidly evolving legal environment.
